1. Scope of this Privacy Policy

This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be stored and processed by us. We are committed to safeguarding your data, and it will never be sold or provided to third parties without your express authorization.

2. Minimum Age Requirement

Please note that you must be 13 years or older to use the Services. Do not use the Services or provide us with any personal information if you are under 13 years of age.

3. Information We May Collect from You

From time to time, we may collect or ask you to provide personal information including (but not limited to) the following: your name, mobile phone number, email address, password, identification credentials, your contacts, biographical data, photographs, and/or payment information.

With your consent, we will collect information about your location and physical movements to enable the UBU application to function properly and to monitor and verify eligible movement forms. You can enable and disable location monitoring at any time using your mobile device's operating system settings.

4. Use of Your Personal Data

As the data controller, we will only use your personal data if we have a legal basis for doing so. The purposes for which we use your personal data, as well as the relevant legal bases on which we do so, are set out in Annex 1.

5. Health and Fitness Data

With your explicit permission, the UBU Application accesses health and fitness data from your device, including:

Steps (number of steps taken)
Steps Cadence (the speed or frequency of your steps)

These data points are accessed via Health Connect to measure and verify your physical activity in order to calculate rewards in the form of UBUs.

The data is used solely to power the core functionality of the app — converting real physical activity into digital rewards. We do not sell, share, or transmit this data to any third party.

You can revoke this permission at any time from your device settings.

6. Who We Share Your Personal Data With

We may share your personal data with the following recipients as necessary to achieve the purposes set out in Annex 1 or as described below: Other users, Service providers, Business partners, Law enforcement, regulators, government authorities, and other third parties for legal reasons, Buyers, and third parties in connection with a business transaction.

Cookies are small text files that are stored on your device when you visit our website or use our application. TERMS OF USE

Introduction

These Terms of Use (the "Terms") set out the conditions under which you may use the UBU Token application ("Application"), the UBU Tokens (a type of cryptographic token) issued by us, our wallet service to access your cryptographic tokens ("Wallet") provided through the application, and any other content and service available through the application, updated or added from time to time. In these Terms, we refer to the application and Wallet, together with all services and content provided by us collectively as the "Service." The Service is owned and operated by The UBU Foundation Ltd, a company registered in the British Virgin Islands under company number 2081818 and registered office at Trinity Chambers, PO Box 4301, Road Town, Tortola, British Virgin Islands ("UBU Foundation", "we", or "us").

Please read these Terms carefully before you start using the Service, as they set out the legal terms of the agreement between UBU Foundation and you for the use of the Service. By downloading, installing, using, or accessing the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you should not use the Service. These Terms contain important information about your rights and obligations regarding the Service. In particular, we draw your attention to the limitations and risks associated with the use of your Wallet and the UBU Token, as well as the limitations of our liability to you, as described in Sections 8, 22, 24, and 26 below.

1. Your Privacy

We only use the personal data we collect through your use of the Service in accordance with our privacy policy, unless you are using a specific service to which a different privacy policy applies, as described in Section 3. Please note that Internet transmissions are never completely private or secure, and any message or information you send through the Service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

3. Your Right to Use the Service

UBU Foundation grants you the right to do the following provided you comply with all rules set out in these Terms:

a. Download, install, and use the application and wallet, and any updates provided by UBU Foundation from time to time, for your personal use only on a compatible mobile device owned by you or under your control; and

b. Use the Service only for your personal, non-commercial, or business use (the "License"). The License is for your personal and domestic use only. You must not use the Service for commercial, business, or resale purposes.

4. Termination of Your Right to Use the Service

UBU Foundation may terminate the License at any time and for any reason (or no reason at all) by giving you at least fourteen (14) days' notice that the License has ended. We may also terminate the License immediately if you breach any provision of these Terms by terminating your UBU token account without prior notice. Upon termination of any of the Licenses, you must immediately cease using and accessing the Service and delete any copies of the Application and Wallet that you possess.

5. UBU Tokens vs UBU Coins

"UBU coins" are units of exchange issued by UBU Foundation that users of the UBU application can generate only through verified physical movement (e.g., steps). UBU coins can be used to obtain certain benefits offered through the UBU coin application. For more information, see here. UBU coins are not the same as UBU tokens. UBU coins are not a cryptographic token and have no viability or use outside the UBU coin application. In the future, you may be able to exchange your UBU coins for UBU tokens, or vice versa. You will be informed about this service through the Application. You acknowledge and agree that UBU tokens cannot be redeemed for cash from UBU Foundation or any of its affiliates.
